Acceptable Use Policy

This Acceptable Use Policy (“AUP”) forms part of the SetterHero Terms of Service. It allocates responsibility for how the Service is used. Breach of this AUP is a material breach permitting immediate suspension or termination.
1. Customer warranties
The Customer represents and warrants, on a continuing basis, that:
- it acts as the data controller in respect of its contacts and has a valid lawful basis and, where required, prior consent / opt-in to contact them through the channels used, including compliance with WhatsApp, Meta and Instagram messaging and opt-in policies and with applicable anti-spam and electronic-communications law (e.g. GDPR, ePrivacy, TCPA and local equivalents);
- it is and remains compliant with all laws and regulations applicable to its own sector and activity, of which Helios has and can have no knowledge;
- all information it provides or causes the Service to communicate is accurate, not misleading, and lawful for its sector (including any professional, advertising, financial, health or consumer-protection rules that apply to it);
- its prompts, automations and message content do not infringe third-party rights and are not unlawful, deceptive, harassing or harmful;
- it has the right to connect and operate the GHL account and messaging channels it uses with the Service.
2. Prohibited uses
The Customer shall not use the Service to:
- send unsolicited, bulk or non-consented messages, or otherwise conduct spam or outreach in breach of platform rules or anti-spam law;
- send content that is unlawful, fraudulent, deceptive, defamatory, harassing, hateful, or that exploits or targets minors;
- misrepresent identity, impersonate others, or make false or misleading commercial, medical, financial or professional claims;
- process special categories of personal data (Article 9 GDPR, including health data) unless the Customer has ensured a valid lawful basis and the processing has been agreed in a signed Order Form (Tier 2);
- circumvent platform protections, scrape, or use unofficial automation methods on any messaging platform;
- configure the AI agent to deny its artificial nature or to impersonate a real natural person, contrary to Section 12 of the Terms and Article 50 of the AI Act;
- infringe intellectual property or violate any applicable law or third-party right.
3. Enforcement and indemnity
We may investigate suspected breaches and suspend or terminate access. The Customer indemnifies Helios for any claim, fine or loss arising from breach of this AUP, consistent with Section 9 of the Terms. The Customer’s liability for its own use and content is not limited by Section 8 of the Terms.
